Terms and Conditions

Bookings

An initial reservation can be made by telephone or online booking form and will be held for 7 days. Completion and return of a booking form and full deposit or payment as appropriate must then confirm this. Failure to comply with this will result in the reservation being released. Bookings made for mid and high season will normally only be accepted for complete weeks. Reservations may be made up to 2 years in advance but will be subject to the rates applying for that calendar year.

Deposit/Security deposit

A 25% deposit is required with the completed booking form, unless the booking is less than 8 weeks away, in which case, payment is required in full. Confirmation of booking will normally be sent within seven days of receipt of deposit. Once the booking is confirmed, the deposit will be non-refundable but will be deducted from the full rental amount due. We find that the majority of guests would rather not worry whether their security deposit will be returned to them, and so instead we ask our guests to pay for an insurance policy to cover accidental damage in the property. The premium for this is £30 / $45. If you would prefer to pay a security deposit, please indicate this on the booking form.

Balance of payment

The balance of the cost is to be paid no later than 8 weeks before the departure date. When a booking is made within 8 weeks of the departure date payment in full must accompany the booking form. Security access codes to the property will be sent to you after full payment has been received. The owners reserve the right to cancel the booking if payment is not received by the due date. Additional services may be purchased after arrival (eg pool heat), however payment is due in full at time of purchase. You will not be able to charge items to your room.

Cancellation charges

The client may cancel the booking at any time after it has been confirmed. Cancellation must be made in writing. The following cancellation charges will apply:

- More than eight weeks before arrival - deposit forfeited.
- Between four and eight weeks before arrival –deposit plus £125 / $200 administration fee forfeited .
- Less than 4 weeks before arrival - 100% of total cost forfeited.

If through circumstances beyond our control, it is necessary for us to cancel (which would be wholly exceptional) we will refund any monies paid, without interest or further compensation. We recommend that travel insurance is purchased prior to the cancellation periods listed above for your protection.

Amendments

Alterations to confirmed bookings can be made at owners discretion and the clients request - an administration fee of £30/$50 may be charged. Changes need to be notified in writing together with the relevant fee.

Occupancy

Florida state law prohibits subletting, sharing or assigning. The home is licenced for a maximum occupancy of 8 persons (not including a child in a crib). Therefore only those persons named on the booking form are allowed to stay in the house, any persons not shown on the booking form will be asked to leave. At least one person in the party must have attained the age of 25 years. Any violators will be evicted according to Florida Statute 508.141 with forfeiture of all monies.

Falsified reservations

Any reservation obtained under false pretense will be subject to forfeiture of reservation deposit, damage deposit, and/or balance of Rental Rate payment.

Arrival/Departure

The rental commences at 4.00pm on the day of your arrival and ceases at 10.00am on the day of your departure during high season cleaning crew may require additional cleaning time and check in may be delayed up to 5 pm. The property will be cleaned before your arrival and again on your departure. All rentals are inclusive of electricity, water, linens, towels and local sales taxes. A telephone is available for your use in the villa, with free calls to North America, but you will need a calling card for international calls. Free High speed Wifi internet is also available.

Pool heating

If pool heat is required, this should be requested at the time of booking. There is an additional charge and this must be paid with the final balance. Pool heaters are heat pumps which fluctuate with ambient temperatures and will heat, on average, to 10 to 15 degrees Fahrenheit above ambient temperatures (rain and windy conditions also affect pool temperature). In cold temperatures pool heat pumps may not operate when temperatures drop below 50 degrees Fahrenheit. Please use pool blanket to conserve energy and help keep the pool warm. In the event that pool heat is requested and paid for, we cannot guarantee the temperature of the pool as this will vary according to the prevailing weather conditions. Please note that Florida Law state that pools may not be heated above 86 degrees Fahrenheit.

Hazardous or illegal activities

The property is equipped with a BBQ, however, this should not be used in patios or in the Unit or on the premises, but should be moved to an outside area and not left unattended. No open flames are permitted. Do not dismantle smoke detectors as they are there for your protection. Use the overhead stove fan when cooking to avoid accidental activation of smoke detector alarm. Tenant and any guests of Tenant shall obey all laws of the state of Florida, as well as local laws, at all times while they are on the premises. Failure to abide by the laws of Florida or the above rules may cause Tenant to be asked to vacate the premises and forfeit all Rental Rates and security/damage deposits. Causing damage to the premises rented or to any of the neighbouring properties and any other acts which interferes with neighbours' right to quiet enjoyment of their premises can also result in eviction with forfeiture of rental rates and security deposit.

Inventory items

No inventory items must be removed from the house. This includes furniture, linens and towels. Any breakages must be reported to the management company immediately. Please do not move furniture around while at the Unit. If you move the furniture and cause damage to the furniture or wall then please inform the management company. An initial supply of paper products is provided. Extra items needed are the responsibility of the Tenant. Limited cleaning supplies may be provided. We recommend that you bring any special items that you may need or purchase them during your stay.

Housekeeping

There is no daily maid service; and, housekeeping will be performed upon check out. Linens and towels are included and not to be taken from the Unit. An initial setup of trash liners, bathroom paper and soap is provided. There is a £65 / $95 one time cleaning fee payable in advance for bookings of 6 nights or less. Additional cleaning fees will be assessed in the event any abnormal use of the Unit or premesis results in the need to perform more extensive cleaning to return the Unit to its condition immediately prior to your Rental Period, or if cleaning involves the removal of excessive debris.

Insurance

Clients are recommended to take out adequate holiday insurance to cover eventualities such as cancellation, accident, sickness and damage.

Liability

The owners or owners agent do not accept liability whatsoever for death, personal injury, accidents, loss or damage to persons or personal effects however caused as a result of the use of the villa or pool. It is the responsibility of an adult member of the party to ensure that children are always properly supervised when in the pool and surrounding area. Please bear in mind that the villa is situated on a development of both residential and vacation homes. Therefore the owners or owner's agent cannot be held responsible for any ongoing construction or alterations to existing houses or any noise as a result thereof on or around the housing development. Agent and Owner, do not assume any liability for loss, damage or injury to persons or their personal property. Neither do Agent and Owner accept any liability for any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, electricity, internet or plumbing, as well as issues due to weather conditions, natural disasters, acts of God, or other reasons beyond their control.

Complaints or disatisfaction

In the unlikely event of a complaint during your stay please contact the management company. If the matter is not resolved the customer must follow up the complaint in writing within 14 days of the end of the rental period. If the problem has not been reported as detailed then the owner cannot be held responsible. Please report any maintenance needs for the Unit or premises to the management company and they will respond as quickly as possible. Refunds will not be made for loss of use due to maintenance issues, including, but not limited to, heating and air conditioning, pool heating, appliances, televisions, DVD/Blu-ray, game consoles and stereos.

Force majeure

The owners or owners agent cannot accept, be responsible for or be liable in respect of loss, damage or changes caused by force majeure (e.g. strikes, floods, closure of airports, weather conditions or other events beyond our control). No compensation will be given for temporary outage of electricity, gas, water, cable, internet or telephone service. Outages will be reported immediately and all efforts will be made to have them restored as soon as possible.

No smoking and no pets policy

Please note the owners do not allow smoking or pets inside the property. Many guests insist that the villa has been smoke and pet free and may ask to be placed in an alternative home if the home smells of smoke or has pet hair, particularly if they have allergies. Cleaning of soft furnishings and carpets to remove smoke odour and pet hair is very costly. Therefore the owners have a strict non-smoking, no pets policy; any guests found to be in breach of this policy will be asked to leave immediately without refund and security deposit withheld to cover any necessary cleaning.

Entry by owner/agent

Owner or Agent may enter the premises under the following circumstances: in case of an emergency; to make any necessary or agreed upon repairs, alterations, or improvements; supply necessary or agreed upon services or show the premises to prospective purchasers, renters or contractors. Owner or Agent will provide Tenant with at least a twenty-four (24) hour notice of Owner’s or Agent’s intent to enter (except in the case of an emergency).

Parking

Parking at the premises is limited to two (2) cars. No boats, jet skis, trailers or RVs.

On day of departure

Tenant agrees to leave the Unit and premises and their contents in the same condition, neat and tidy, as Tenant found the Unit and premises to be upon arrival, normal wear expected. Beds should be stripped of linens and placed in a pile in each bedroom for housekeeping. All dishes are to be washed and all garbage removed from the Unit and premises, and placed in outside receptacles. Please place trash bins in front of home for pickup or follow instructions listed in welcome book. Close all blinds in all rooms and set the thermostat to "cool" and 79 degrees f. Please lock the Unit each time you leave the Unit and premises, and upon check out.
